RECOMMENDATION
Staff recommends the City Council (1) discuss and reconsider the composition of the Ad Hoc Minimum Wage Ordinance Subcommittee; (2) discuss and reconsider the composition of the Ad Hoc Digital Kiosk Subcommittee, and provide related direction regarding the process for consideration of the Digital Kiosk Siting Plan; (3) if desired, dissolve or change the composition of the Subcommittees; and/or (4) provide other direction to the City Clerk as deemed appropriate.
BACKGROUND
The City Council has traditionally appointed Council Member(s) to represent the City on various City Council Subcommittees.
The Ad Hoc Minimum Wage Subcommittee was created on May 9, 2022, for the purpose of consideration of numerous decision points that would be needed to develop a potential Minimum Wage Ordinance. The Subcommittee’s current members are Mayor Puza and Council Member O’Brien. The Subcommittee will continue its work with City staff during the preparation and review of the economic impact study and drafting of a proposed Ordinance for recommendation to the City Council.
The Ad Hoc Interactive Digital Kiosk Program Subcommittee was created at the October 28, 2024, City Council Meeting, during which time Council Member O’Brien and Council Member Vera were appointed thereto. The Subcommittee’s work included determining the terms of the contract and considerations regarding siting, with the final site selection to return to a future City Council meeting for approval.
On January 12, 2026, the City Council reappointed the same members to each of the Subcommittees for another year.
On February 23, 2026, during Items from Council Members, the City Council expressed concerns regarding a potential conflict of interest with Council Member Dan O’Brien holding an independent contractor position as President and CEO of the Culver City Chamber of Commerce (Chamber) and sitting on several subcommittees, and specifically identified concerns with the Ad Hoc Short-Term Rental Subcommittee, Ad Hoc Interactive Digital Kiosk Program Subcommittee, and Ad Hoc Minimum Wage Subcommittee. In response to hearing his colleagues’ concerns, Council Member O’Brien requested the City Attorney’s Office to request guidance from the FPPC as to these three specific subcommittees/issues.
The FPPC provided a response (Attachment 1) determining that, while there is no conflict with Council Member O’Brien being a member of the Short-Term Rental Subcommittee or participating in that issue, there is a conflict of interest with the CEO of the Chamber being a member of the Ad Hoc Interactive Digital Kiosk Program Subcommittee and Ad Hoc Minimum Wage Subcommittee and participating in those issues.
DISCUSSION
In light of the limitations of the Brown Act, Staff has identified the following viable options for Council participation:
1. Reconsider the Composition of the Ad Hoc Minimum Wage Subcommittee and Ad Hoc Interactive Digital Kiosk Program Subcommittee.
2. Direct the Subcommittee(s) to Continue with the Remaining Council Member: If desired, the City Council could direct that the remaining Council Member on each of these Subcommittees continue to work with City staff on these issues.
3. Dissolve the subcommittee(s): This would require staff to bring all work regarding these issues to the full City Council.
The Ad Hoc Minimum Wage Subcommittee
This subcommittee has not met recently. At the April 13, 2026, City Council meeting, Mayor Puza received consensus for staff to explore a residential minimum wage program.
Ad Hoc Interactive Digital Kiosk Program Subcommittee
An agenda item was scheduled for April 27, 2026, to consider approval of the Siting Plan to implement the Interactive Digital Kiosk Program. With the new information, the Subcommittee’s recommendation to the City Council should not be considered and the item has been pulled from the agenda and rescheduled for May 11, 2026. Staff is seeking direction from the City Council as to the process for considering the Digital Kiosk Siting Plan in light of the changed circumstances, which includes the following options:
1. If the Subcommittee is reconstituted, staff can meet with the new Subcommittee in order to receive a Subcommittee recommendation to present to City Council on May 11th.
2. Regardless of whether the Subcommittee is reconstituted, City Council could direct staff to provide all of the information initially considered by the Subcommittee to the full City Council on May 11th without a Subcommittee recommendation.
FISCAL IMPACT
There is no fiscal impact associated with the discussion and direction on this item.

B. Regardless of whether the Subcommittee is reconstituted, direct staff to provide all of the information initially considered by the Subcommittee to the full City Council on May 11th without a Subcommittee recommendation.
