RECOMMENDATION:
Staff recommends that the City Council hold a public hearing, consider all
presentations from the public and determine what charges should be assessed to
each benefited property for the services provided. Upon closing the public hearing,
City Council is requested to confirm the assessments, the diagrams and order the
maintenance assessment for Fiscal Year July 1, 2005 to June 30, 2006 by adoption
of a resolution, unless the results of the public discussion dictate otherwise.
PROCEDURE:
Mayor: Announce that this is the time and place for the public
hearing to discuss the annual levy of assessments for
Landscaping Maintenance District No. 1 (LMD#1) for Fiscal
Year 2005/2006.
City Clerk: Announce that notice of this hearing has been given
pursuant to the provisions of the ‘Landscaping and Lighting
Act of 1972’, which is in Division 15 of the Streets and
Highways Code of the State of California, and pursuant to
the provisions of the City Council's Resolution 2005-R034,
and that the following affidavits are on file in his office:

BACKGROUND:
LMD#1, consisting of two zones, was created for the purpose of providing on-going
maintenance of landscaping along:
‘Zone 1’ (Studio Estates), being the periphery of the MGM Lot 2 residential
subdivision; and
‘Zone 2’ (Ballona Creek), being the 20-foot wide strip along the southerly side of
Ballona Creek from the easterly side of Overland Avenue to the northeasterly
line of Westside Business Park, a distance of about 2,200 feet.

Zone 1 was the result of a City Council conditional approval of the subdivision being
created. The subdivider wanted to develop an area that was surrounded by
landscaping within the public right-of-way. The City Council allowed, in perpetuity,
the additional landscaping along Elenda Street and Culver Boulevard conditioned
upon the formation of a landscape maintenance district, paid for by the property
owners.
The assessment for the District includes costs for providing complete maintenance,
administration, and preparation of the City Engineer's Report.
Recent Assessment History
The annual amounts collected for Zone 1 and Zone 2 in Fiscal Years 1994/95
through 2002/03 were $15,211.80 and $7,500.00, respectively.
In Fiscal Year 2003/2004 the property owners within Zone 1 supported an increase
of $4,534.20, or $25.19 per property, by a vote of 67 to 33 percent. Zone 2 carried
a surplus of $1,500.00 over to the Fiscal Year 2004-2005 assessment.
Therefore, the total assessments for Fiscal Year 2003/04 and Fiscal Year 2004/05
were $19,746 for Zone 1 and $7,500 for Zone 2, respectively.
DISCUSSION
On April 4, 2005, the City Council adopted Resolution 2005-R018, ordering the
preparation of the City Engineer's Report, which is required by the State of
California’s Streets and Highways Code, prior to scheduling a public hearing on the
next fiscal year's assessment for landscaping maintenance.
On May 9, 2005, the City Council adopted Resolution 2005-R034, approving the City
Engineer's Report that addressed the District’s annual budget and corresponding
charges to be levied to cover all costs for the next fiscal year's assessment and
setting June 27, 2005 as the date for the public hearing.
The estimated costs to be incurred during the 2005/06 Fiscal Year are $19,704.00
for Zone 1 and $6,186.00 for Zone 2. Staff is recommending that the assessment
for Zone 1 remain the same as last year ($19,746) and that the $42 surplus be
carried over to next fiscal year 2006/07. For Zone 2, staff recommends that the
surplus for fiscal years 2002/03 and 2004/05 in the amounts of $1,380 and $1,500,
respectively, be applied as a credit and that the total assessment for Zone 2 be

The Park Division is responsible for overseeing all landscape maintenance work
performed by the contractor as well as contract management including bidding
process and contract award.
If a simple majority protest exists for continuing the existing annual assessment, the
City Council could still impose the existing assessment with a 4/5ths majority vote.
Alternatively, the City Council could, by simple majority, order the District disbanded
and discontinue the services. A resolution implementing that disbanding action
would be brought back at a subsequent meeting.
Lastly, City Council could, by 4/5ths majority vote, suspend collection of that
assessment and continue the services, funding them with the City’s General Fund.
This report and the Resolutions were prepared in conjunction with the City Attorney’s
Office.

FISCAL ANALYSIS:
The Landscaping Maintenance District No. 1 budget should be 100 percent self-
supporting for all expenditures. Property owners within the District are charged for
their fair share of these costs, as described in the City Engineer’s Report.

have prepared and hereby submit this Report
LANDSCAPING MAINTENANCE DISTRICT NO 1 (hereinafter referred to as District")
described herein has been formed in accordance with the Landscaping and Lighting Act
of 1972 being Division 15 Part 2 of the Streets and Highways Code of the State of
California
This report consists of the following seven parts that are submitted herewith and made
a part hereof
I Maps of District Boundaries and Parcels
Landscaping Maintenance District No 1 consisting of certain public property and
the real property within the District subject to assessment is shown on maps
consisting of two pages which have been filed in the Office of the City Clerk on
May 21 1979 April 21 1980 April 12 1982 and April 11 1983 and by this
reference are made a part hereof (pages 10 and 11)

2III Landscaping and Irrigation System Plans
The landscaping maintenance areas were constructed in several phases and
improved with irrigation systems The initial improvements for Zone 1 were
constructed by a developer in accordance with approved plans under separate
bonded agreement The plans for the initial improvements for Zone 1 consist of
landscaping plans Drawing No 5024-39g (one sheet) approved January 21 1980
and landscape irrigation system plans Drawing No 4024-39g (two sheets)
approved January 3 1979 The plans for the initial improvements for Zone 2
consist of landscaping planting and irrigation plans Drawing No 5024-39g (four
sheets) approved May 3 1978 The plans for the initial improvements of
Annexation No 1 to Zone 2 consist of landscaping plans Drawing No 5049-55g
(sheet 16 of 19) approved April 1 1982 and landscape irrigation system plans

IV Performance of Maintenance by City Forces and/or Contractor
The maintenance of the improvements is provided by City of Culver City forces
and/or pursuant to maintenance contracts awarded by the City and the costs
thereof shall be assessed to the benefiting properties within the District
V Parcel Assessments Based Upon Benefit Received
It is proposed to assess the total amount of maintenance and incidental costs for
maintaining the landscaped areas to the individual parcels of real property within
the District in proportion to the estimated benefit to be received by such parcels of
real property The assessments of such costs commenced upon acceptance of
the improvements by the City of Culver City and the commencement of
maintenance This fiscal year assessment is calculated to be $109 70 per lot for
Zone 1 and $0 0054 per square foot of assessable land for Zone 2 based on the
data shown in Tables I ll III IV and V The proposed individual assessments are
shown on the attached assessment roll
VI Method of Assessment
The District is divided into two zones Zone 1 and Zone 2 Zone 1 consists of all
the lots in Tracts 34390 34371 36218 eight of the nine lots of Tract 33484 and
thirty-one of the thirty-two lots of Tract 28805 all of which derive an equal benefit
from the Zone 1 landscaping Zone 2 consists of the Westside Business Park and
eight other parcels of land adjoining Westside Business Park on the west Each
parcel in Zone 2 derives a benefit from the Zone 2 landscaping based upon the
area of that parcel The assessments will be spread according to the following

VII Estimated Cost of Maintenance and Improvements
The estimated cost of maintenance and improvements for each zone for the fiscal
year shall include in total or in part the following
A The total cost of constructing or installing all proposed improvements and
maintaining and servicing all existing and proposed improvements including
all incidental expenses
B The amount of any surplus or deficit in the District Fund to be carried over
from the previous fiscal year
C The amount of any contributions to be made from sources other than
assessments levied pursuant to District assessment proceedings
D The amount if any of the annual installment for an assessment ordered by
the City Council wherein the estimated cost of any improvements shall be
levied and collected in annual installments
E The net amount to be assessed upon assessable lands within the District shall
be the total maintenance and improvement costs as referred to in A above
increased or decreased as the case may be by any of the amounts referred
to in B C or D above
F Item B above may specify individual parcels within a zone that did not receive
notice of or pay assessments levied by the City Council and which
assessments are carried over and added to the assessments for the current
fiscal year for each such specified parcel
4It is recommended for Fiscal Year 2005-2006, the District be assessed a total of
$23,052 00, with Zone 1 being assessed $19,746 00 and Zone 2 being assessed
$3,306 00 The assessment amount for Fiscal Years 1994-95 to 2002-03 was
$22 711 80 with Zone 1 assessed $15 211 80 and Zone 2 assessed $7 500 00 For
Fiscal Year 2004-05 the District was assessed a total of $27 246 00 with Zone 1 being
assessed $19 746 00 and Zone 2 being assessed $7 500 00
In Fiscal Year 2003-2004 Zone 1 approved an increase in its assessment of $4 534 20
(to a total of $19 746 00) while Zone 2 carried a surplus of $1 500 00 towards Fiscal
Year 2004-2005 assessment as permitted per Section VII B of this report given its
actual cost for services of $6 000 00 During the 2003-2004 proceedings it was
recommended that an increase/decrease to the assessment be triggered when an
estimated surplus/deficit reaches $1 600 thus the threshold was not reached This was
the estimated cost to the City in staff time to complete the procedure required to
increase an assessment per Proposition 218 For the same reasons staff
recommended proceeding with the increase procedures for Zone 1
For Fiscal Year 2004-2005 the increase (or decrease) trigger threshold was $2 160
The increase in the threshold was due to more accurate accounting after going through
the process [the previous year coupled with increased costs for staff time Given this
fact a decrease is not recommended for Zone 1 whose cost estimate for services is
$19 704 00 a difference of $42 from the previous assessment
It is recommended that the Zone 2 assessment be decreased to $3 306 The actual
estimated cost for services is $6 186 however the District has carried a surplus for the
last two fiscal years for a total amount of $2 880 00 It is recommended that this surplus
be applied as a credit to reduce the assessment costs for Zone 2

EXHIBITS A and B respectively

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CULVER CITY, CALIFORNIA, ORDERING MAINTENANCE
WORK AND CONFIRMING THE DIAGRAMS AND
ASSESSMENT FOR THE LANDSCAPING MAINTENANCE
DISTRICT NO 1
WHEREAS, The City Council of the City of Culver City has previously
ordered the formation of a landscape and lighting maintenance district pursuant to the
provisions of Division 15, Part 2 of the California Streets and Highways Code, known as
the 'Landscaping and Lighting Act of 1972, for a maintenance district to be known and
designated as Landscaping Maintenance District No 1 (hereinafter referred to as the
Maintenance District") and
WHEREAS the City Council of the City of Culver City ordered the
preparation of a Report on the Annual Levy 2005-2006, Landscaping Maintenance District
No 1' (hereinafter 'Report ), and the City Engineer has prepared and filed this report with
this City Council pursuant to law, for its consideration and subsequently thereto the City
Council approved the Report by Resolution of Intention, 2005-R034 proposing to order the
annual assessment levy and to collect the assessments, and to carry on all other
proceedings necessary for the levy of annual assessments for the Maintenance District,
and further proceeded to give notice of the time and place for a public hearing on the
question of the levy of the proposed assessment (the "Public Hearing )
WHEREAS, the City Council has heard all testimony and evidence at the
Public Hearing and is desirous of proceeding with the levy of annual assessment for the
Maintenance District
NOW, THEREFORE, the City Council of the City of Culver City, DOES
HEREBY RESOLVE as follows-2-

1 Upon the conclusion of the Public Hearing written protests filed and
not withdrawn did not represent property owners owning more than fifty percent (50%) of
the area of assessable lands with in the Maintenance District|109| The City Council hereby orders the maintenance work to be done as
set forth in the Report and the Resolution of Intention No 2005-R034 and orders the
annual levy of the Maintenance District as shown and set forth and described in the Report
and the Resolution of Intention|109| The diagrams and assessment as set forth and contained in the
Report are hereby confirmed and adopted by the City Council|109| The adoption of this Resolution constitutes the levy of the
maintenance assessment for the fiscal year commencing July 1, 2005 and ending June 30
2006
5 The estimates of costs, the assessment diagrams, the assessments,
and all other matters as set forth in the Report pursuant to the Landscaping and Lighting
Act of 1972 as submitted are hereby approved and adopted by the City Council|109| The maintenance work set forth in the Report and the Resolution of
Intention shall be performed pursuant to law, and the County Auditor shall enter on the
County Assessment Roll the amount of the assessment, and the assessment shall then be
collected at the same time and in the same manner as the County property taxes are
collected After collection by said County, the net amount of the assessment shall be paid
to the City Treasurer of the City of Culver City|109| The City Treasurer has previously established a special fund known as
the Fund for Landscaping Maintenance District No 1 into which the City Treasurer shall
place all monies collected by the Tax Collector pursuant to the provisions of this Resolution
and law, and the transfer shall be made and accomplished as soon as the monies have

28|109| The City Clerk is hereby ordered and directed to file a certified copy of
the diagrams attached hereto as Exhibit A , and the assessment roll with the County
Auditor, together with a certified copy of this Resolution upon its adoption
