RECOMMENDATION
Staff recommends the City Council adopt a Resolution confirming the March 16, 2022 Fortieth Supplement to Public Order: (1) Rescission of Requirements under Thirty Eighth Supplement for Proof of COVID-19 Vaccination to Enter Certain Indoor Businesses and Indoor City Facilities; (2) Requirement of a Well-Fitted Mask for Members and for the Public to Attend In-Person City Council Meetings and all In Person City Commission, Board and Committee Meetings, issued by the City Manager, as Director of Emergency Services, under City of Culver City emergency authority, due to the Coronavirus Respiratory Disease (COVID-19) Pandemic.
BACKGROUND/DISCUSSION
On March 14, 2020, the City Manager, as Director of Emergency Services, issued a Proclamation of Local Emergency, due to the outbreak and spread of the Coronavirus Respiratory Disease (COVID-19), which was ratified by the City Council on March 18, 2020 by Resolution No. 2020-R015. Beginning on March 16, 2020, the City Manager issued a number of public orders in regard to restrictions and limitations on business operations, recreational activities, social gatherings and other public health safety measures.
The Thirty-Eighth Supplement to Public Order, issued October 26, 2021 and amended November 8, 2021, required proof of full COVID-19 vaccination to enter certain indoor public locations, events, and City facilities. This measure was required due to the continued high transmission of COVID-19 in the community, and the City’s interest in increasing vaccination rates which, in turn, helped stem the spread of COVID-19 and protects the City’s residents, employees, and visitors.
In February 2022, after the winter surge of COVID-19 cases, the Los Angeles County Department of Public Health (LACDPH) discontinued the pre-entry vaccination requirements for patrons and employees of certain businesses as previously required and removed the County’s universal mask requirement except for enumerated high risk settings.
On March 14, 2022, at a regular public meeting, the City Council directed the City Manager to discontinue the City’s vaccination requirements that were previously instituted under the Thirty-Eighth Supplement to Public Order. In addition, the City Council determined that it would resume in-person City Council meetings beginning at its April 11, 2022 regular meeting, and that all City Commissions, Boards and Committees would resume in person meetings in April.
In an abundance of caution, due to the indoor setting, indoor ventilation issues, and to protect persons who are most vulnerable to serious illness from COVID-19, including those who are immunocompromised or unable to be vaccinated, the City Council voted to require all persons who attend the in-person City Council, Commission, Board and Committee meetings to wear a well-fitted mask while indoors. This requirement offers an alternative approach to more stringent measures. The City seeks to promote the health, safety, and welfare of its residents and visitors, and to protect its employees.
Confirmation of Public Orders
Pursuant to CCMC Section 3.09.020.B.1.h(2), staff recommends the City Council adopt the proposed Resolution confirming the March 16, 2022 40th Supplement to Public Order, which rescinded the requirements under the 38th Supplement to Public Order for pre-entry proof of vaccination for City facilities and certain indoor businesses. Pursuant to City Council direction, the Order also requires a well fitted mask for members and for the public to attend in person City Council meetings and all in person City Commission, Board and Committee meetings.
FISCAL ANALYSIS
There may be staff costs associated with confirming the Order and adopting the Resolution.
