RECOMMENDATION

Staff recommends the City Council adopt a resolution adopting a Notification of Intent to Comply (NOI) with SB 1383 regulations and authorizing the submittal of the NOI to CalRecycle, in compliance with SB 619 (Attachment 1).


BACKGROUND/DISCUSSION

SB 1383, the Short-lived Climate Pollutant Reduction Act of 2016, required CalRecycle to develop regulations to reduce organics in landfills as a source of methane. These regulations placed requirements on multiple entities, including municipalities, residential households, businesses, commercial edible food generators, haulers, solid waste facilities, food recovery organizations, and food recovery services, to support achievement of the statewide organic waste disposal reduction targets set by state legislation.

SB 1383's requirements include:
* additional organics collection programs
* processing facility requirements
* conducting contamination monitoring
* providing outreach and education
* maintaining a detailed database
* compiling and submitting reports
