RECOMMENDATION

 

Staff recommends the City Council (1) adopt a Resolution approving an application for grant funds through CalRecycle for the Household Hazardous Waste Grant Program (FY 2021-22) HD37 with Culver City as the lead agency in partnership with West Hollywood; and (2) approve a professional services agreement with California Product Stewardship Council to submit the application on behalf of the City.

 

 

BACKGROUND/DISCUSSION

 

Public Works Environmental Programs and Operations Division (EPO) has had a battery program in place for 15 years. Batteries are banned from the landfill; however, cities must bear the burden for disposal costs. Funding to continue and expand the program in the future and how best to achieve this has been a concern.

 

The current battery program consists of a disposal box at the Senior Center for residents and several collection containers at city facilities for staff. EPO staff manage the collection, and disposal of the batteries. Primarily these are small batteries such as A type or C type alkaline batteries or smaller type batteries used for watches and other small tech gadgets which are also primarily lithium batteries. The disposal of these batteries is provided through agreements with vendors who can take this type of material for proper disposal.

 

The Household Hazardous Waste (HHW) grants are primarily competitive grants made available by the California Department of Resources Recycling and Recovery (CalRecycle) per Public Resources Code, Division 30, Part 7, Article 3.5, Section 47200 to help local governments establish or expand HHW collection programs.

 

Only one application per qualifying entity will be accepted. Eligible applicants may submit an individual or regional application. For a Regional grant application, one entity must be identified as the lead applicant to act on behalf of itself and its participating jurisdictions. When an application is submitted as a regional application the funding is doubled to $100,000.00

 

Culver City has partnered with West Hollywood to secure the higher grant funding. We are pleased to work together on this grant as West Hollywood is a longtime partner with Culver City on another grant for Used Oil Payment Program (OPP). The existing collaboration, similarities of city size, demographics and proximity to Culver City make it an ideal city to work with for the duration of this grant term.

 

The other partner in this grant application includes California Product Stewardship Council (CPSC). CPSC has been an advocate for Extended Producer Responsibility. In 2018, Culver City Council signed a resolution working with the group to further the goal of creating sustainable disposal programs for items like batteries.

 

If the grant funding is awarded, CPSC will assist Culver City and West Hollywood in crafting an educational marketing program along with securing up to 27 locations between the two cities to place disposal boxes.

 

The two main components of the proposed project include public education to include crafting an educational campaign to educate the public regarding proper use and proper disposal of batteries using social media, videos and print media., and recruitment of a limited number of retailers to host battery collection boxes (each box would include disposal costs and would not result in batteries being sent to Culver City Transfer Station).

 

Pursuant to Culver City Municipal Code Section 3.07.065, CPSC’s services are exempt from bidding requirements, provided the agreement is based on competitive quotes, whenever practical, as determined by the City Manager.  Based on the foregoing and CPSC’s unique qualifications and history with Culver City, the City Manager determined competitive quotes are not practical in this case.

 

 

 

 

 

FISCAL ANALYSIS

 

The amount being requested from the grant is $100,000. 00 to cover the cost of design and implementation of the educational campaign, purchase of battery boxes and to provide a battery collection event during the grant period. There is no matching amount required. 

 

If grant funds are awarded, staff will return to Council for acceptance of the grant award and to amend the budget and establish Refuse Fund accounts for both revenues and the expenditures associated with the grant.

MOTION

 

That the City Council:

 

1.                     Adopt a Resolution approving an application for grant funds with a Regional Resolution for Household Hazardous Waste (HHW) Grant with Culver City as the lead agency in partnership with West Hollywood; and

 

2.                     Authorize the City Manager to enter into a professional services agreement with California Product Stewardship Council to submit the application on behalf of the City; and

 

3.                     Authorize the City Attorney to review/prepare the necessary documents; and

 

4.                     Authorize the City Manager to execute such documents on behalf of the City.
