RECOMMENDATION
Staff recommends the City Council (1) adopt a Resolution authorizing the City to enter into an agreement with the Los Angeles County Flood Control District for the transfer of Department of Water Resources Proposition 1 Grant Funds for the Mesmer Low Flow Diversion Project; and (2) approve of related budget amendment (requires a four-fifths vote).
BACKGROUND/DISCUSSION
The Public Works Department’s Environmental Programs and Operations Division (PW-EPO) Staff is proposing a low flow diversion system that will divert dry weather run-off from Centinela Creek Channel into the Mesmer Pump Station where the run-off will be pumped into an existing sewer main for conveyance to City of Los Angeles’ Hyperion Water Reclamation Plant (Hyperion) for treatment and water recycling program. The Mesmer Sewer Pump Station is located at 5586 Mesmer Avenue, Culver City, CA 90230 adjacent to Centinela Creek Channel.
This required Project is one of three projects approved in the Time Schedule Order (TSO) to comply with the Ballona Creek Bacteria TMDL. The Project is jointly funded by the cities of Los Angeles, Beverly Hills, Culver City, Inglewood, and West Hollywood, the County of Los Angeles and Los Angeles County Flood Control District. The following three regional projects collectively comply with the final water quality-based effluent limitations during dry weather as specified by the Ballona Creek Bacteria TMDL:
1. Low Flow Treatment Facility (LFTF) #1 Project at Ballona Creek;
2. Low Flow Treatment Facility (LFTF) #2 Project at Sepulveda Channel; and
3. Mesmer Low Flow Diversion Project at Centinela Creek.
Culver City is taking the lead in managing both design and construction of the Mesmer Low Flow Diversion Project with City of LA managing the LFTF #1 & #2 Projects.
Design
Mesmer Low Flow Diversion (LFD) System Project is designed to divert dry weather run-off from Centinela Creek Channel into a proposed inlet constructed along the channel. The inlet will be connected to a new 12-inch diameter pipe that will convey the run-off into a new receiving wet well adjacent to the Mesmer Pump Station. From the receiving wet well, the run-off will be pumped and sent through a new 6-inch diameter force main that will take the run-off and discharge into the existing sanitary sewer wet well. Both the sewer and dry weather run-off collected in the existing sanitary wet well will be pumped to the sanitary force main for conveyance to Hyperion for treatment. The project is currently 75% designed and is currently in the process of Army Corp and Los Angeles County Flood Control District permitting. It is anticipated that all the permits required will be secured by December 2020.
In November 2014, the voters of California enacted the Water Quality, Supply and Infrastructure Improvement Act of 2014 (referred to as Proposition 1). Proposition 1 amended the California Water Code Section 79740 et seq., which authorizes the legislature to appropriate $ 510M for Integrated Regional Water Management (IRWM) water resources-related projects that address water supply, water quality and habitat/open space needs in a region. The intent of the IRWM concept is to encourage integrated regional strategies for the management of water resources and to provide funding through competitive grants for projects that protect communities from drought, improve water reliability, protect and improve water quality, and improve local water security by reducing dependence on imported water.
The California Department of Water Resources (DWR) issued Proposition 1 IRWM Grant Program Guidelines and Proposal Solicitation Package in April 2019. Public Works Environmental Programs & Operations Division (PWEPO) staff submitted a proposal for funding in the amount of $850,000 for the Mesmer Low Flow Stormwater Diversion Project. On September 29, 2020 the DWR announced nearly $37M in grant awards for water resilience projects in Los Angeles and Ventura Counties. The City’s Mesmer Low Flow Stormwater Diversion project was awarded $607,846.99 through DWR’s Proposition 1 grant funds to be administered by the Los Angeles County Flood Control District.
Pursuant to Section 16.05.A.1 of the Los Angeles County Flood Control District Code, prior to City’s receipt of these funds, the City must enter into a Transfer Agreement with the Los Angeles County Flood Control District.
FISCAL ANALYSIS
A budget amendment is requested for DWR Proposition 1 IRWM grant Funds for the Mesmer Low Flow Stormwater Diversion Project in the amount of $ 607,856.99. Funds received will be deposited in account 423.80000.340880.PR005. Funds will be expended in accordance with grant requirements from account 434.80000.730100 PR005. A budget amendment requires a four-fifths vote.

1. Adopt a Resolution authorizing the City to enter into an agreement with the Los Angeles County Flood Control District for the transfer of Department of Water Resources Proposition 1 Grant Funds for the Mesmer Low Flow Diversion Project and;
2. Approval of related budget amendment (requires four-fifths vote); and
3. Authorize the City Attorney to review/prepare the necessary documents; and
4. Authorize the City Manager to execute such documents on behalf of the City.
