RECOMMENDATION

Staff recommends the City Council adopt an Ordinance amending Culver City Municipal Code Section 13.03.025, regarding the consumption of alcoholic beverages on streets and public parks.


BACKGROUND/DISCUSSION

At its meeting of February 25, 2019, the City Council introduced an Ordinance (Attachment 1) amending CCMC Section 13.03.025.A to allow the issuance of alcohol use permits for the consumption of alcoholic beverages on streets and public parks as follows:
1. Beer and wine; no other alcoholic beverages.
2. In Veterans' Memorial Park only; no other parks.
3. On streets, sidewalks or alleys that have been closed for a special event.
4. City-produced or City-sponsored special events only; no private events (this continues the prohibition on alcohol on public rights-of-way at block parties).

Prior to its introduction, the City Council requested modification to Section 13.03.025.A to define beer and wine to be consistent with state law definitions and consistent with California Department of Alcoholic Beverage Control requirements. The Ordinance has been modified to reference California Business and Professions Code Sections 23006 and 23007, which define "beer" and "wine" as follows:
