RECOMMENDATION
Staff recommends the City Council (1) create a City Council Ad Hoc Subcommittee to work with City staff to review the City’s regulations and policies pertaining to the service of alcohol at special events held in City parks and other public property and on public rights-of-way; and (2) appoint two City Council Members thereto.
BACKGROUND/DISCUSSION
Currently, Culver City Municipal Code (CCMC) § 13.03.025.A, regarding the consumption of alcoholic beverages on streets and public parks states:
No person shall consume any beer, wine or alcoholic beverage while on any street, sidewalk, alley, highway, public playground or public park. Possession of any bottle, can or other receptacle, containing any beer, wine or alcoholic beverage which has been opened or a seal broken, or the contents of which have been partially removed, while on any street, sidewalk, alley, highway, public playground or public park creates a rebuttal presumption that the person possessing the same is consuming its contents. For purposes of this Section, the interior of the Veterans’ Memorial Building or the Ivy Substation shall not be considered to be within a public playground or park, and the consumption of alcohol within a duly licensed outdoor dining area shall not be considered to be on a sidewalk. Notwithstanding the provisions of this Subsection, the City Council shall have the authority to grant by resolution a permit to conduct a beer and wine garden in Veterans’ Memorial Park during the City's Fiesta La Ballona event.
In the past, individuals and event planners have approached the City Council and staff to request to serve alcoholic beverages at special events held in City parks and on public rights-of-way (such as a street, alley, or sidewalk). CCMC § 13.03.025 does not permit this activity, beyond what can be considered for Fiesta La Ballona in Veterans’ Memorial Park. In addition, City policy regulating block parties also prohibits alcohol on City public rights-of-way.
As the City continues to receive requests for the service of alcohol at special events located in parks on public rights-of-way, staff recommends the City Council create an Ad Hoc Subcommittee to work with City staff (from the City Manager’s and City Attorney’s Offices, and the Police, Public Works and PRCS Departments) to review the City’s current regulations and policies pertaining to the service of alcohol at special events held in parks and other public property and on public rights-of-way, and make recommendations to the City Council for consideration at a future meeting.
FISCAL ANALYSIS
There is no fiscal impact to form a City Council Ad Hoc Subcommittee.

MOTION
That the City Council:
1. Create a City Council Ad Hoc Subcommittee to work with City staff to review the City’s regulations and policies pertaining to the service of alcohol at special events held in parks and other public property and on public rights-of-way; and
2. Appoint two City Council Members thereto; or
3. Provide alternate direction as deemed appropriate.
